Terms and Conditions

Please read these terms carefully before using https://jemshitmavlyanov.com/ (the “Site”) and purchasing the online courses offered on it. By creating an account or purchasing a course, you agree to these terms.

1. Who we are

The Site is operated by QUICK FLOW SRL, a company registered in Romania:

In these terms, “we”, “us” and “the Company” mean QUICK FLOW SRL.

2. Definitions

  • User: any person who accesses the Site.
  • Client: any person who purchases an Online Course on the Site.
  • Online Course: the recorded video lessons offered for sale on the Site.
  • Account: the personal area where the Client accesses purchased courses.

3. What we offer

We offer recorded online video courses taught by Jemshit Mavlyanov. Each purchased course can be accessed for 6 months from the date of payment, from any device with an internet connection.

To watch the lessons you need an internet connection and an up-to-date browser (Chrome, Safari, Firefox or Edge) on a computer, tablet or phone. Lessons play in the browser through the Vimeo player and cannot be downloaded. The course is supplied as described on the course page at the time of purchase; we do not undertake to provide content updates, and any lessons added later are a bonus.

After completing all lessons of a course, the Client receives a certificate of completion. The certificate confirms that the Client has gone through the course materials. It is not an accredited qualification and is not recognised by the Romanian Ministry of Education.

Courses do not include individual feedback or direct Q&A with Jemshit Mavlyanov, unless stated otherwise on the course page.

4. Account

To purchase a course you need an Account, created with your email address. We do not use passwords: you log in with a one-time link sent to your email. Your name and phone number are optional and you can add them in your Account at any time. You enter your billing details at checkout. You must be at least 16 years old.

You are responsible for the security of the email address you use to log in and for the accuracy of the information you provide. Your Account is personal: sharing access with other people is not allowed.

5. Prices and payment

Prices are shown on the Site in euro (EUR) and are the final price you pay at checkout; no other taxes are added. QUICK FLOW SRL is not registered for VAT, so no VAT appears on the invoice.

Payment is made online by card (Visa, Mastercard, American Express) through Stripe. We do not see or store your card details.

From time to time we may offer a course at a reduced price for a limited period, or promotional codes. The end date of each offer is shown together with the offer. If we announce a price reduction, we also show the prior price, meaning the lowest price we applied in the 30 days before the reduction.

6. Access to courses

After the payment is confirmed, you get immediate access to the course in your Account. Access lasts 6 months from the date of payment. After that, the course is no longer available in your Account.

7. Right of withdrawal

If you are a consumer, you normally have the right to withdraw from an online purchase within 14 days, without giving a reason.

Our courses are digital content supplied immediately after payment. Before paying, you will be asked to:

  1. expressly request that access to the course starts immediately, and
  2. acknowledge that, once access starts, you lose your right of withdrawal.

Once you have given this consent and the course has been made available in your Account, the purchase cannot be withdrawn and is not refundable, in accordance with Article 16(m) of Romanian Government Emergency Ordinance no. 34/2014 and Article 16(m) of Directive 2011/83/EU. We confirm this consent in the order confirmation email.

If, exceptionally, access to the course has not started (for example because of a technical problem), you keep your right of withdrawal for 14 days from the date of payment. You can exercise it by emailing office@jemshitmavlyanov.com with a clear statement that you withdraw from the contract and your order number, or by using the model withdrawal form annexed to Government Emergency Ordinance no. 34/2014. We will confirm receipt by email and refund the amount paid, using the same payment method, within 14 days of receiving your request.

Losing the right of withdrawal does not affect your legal rights if the course does not correspond to its description or cannot be accessed (see section 8).

8. Conformity of the course

Courses are digital content and are covered by the legal guarantee of conformity under Romanian Government Emergency Ordinance no. 141/2021 on contracts for the supply of digital content and digital services. We are liable if, during your access period, the course does not correspond to its description on the Site or cannot be accessed for a reason within our control.

If you notice a lack of conformity, write to office@jemshitmavlyanov.com. We will remedy it within a reasonable time and free of charge (for example by fixing the lesson or reactivating your access). If we cannot, you are entitled to a proportionate price reduction or, unless the lack of conformity is minor, to terminate the contract and get a refund.

For a lack of conformity that appears during the access period, the burden of proving that the course was in conformity lies with us, as provided by law. The guarantee does not cover problems caused by your device, browser or internet connection where they do not meet the requirements in section 3; if we ask, please help us establish whether the problem comes from your digital environment.

9. Intellectual property

All content of the Online Courses (videos, images, texts and any other materials) belongs to QUICK FLOW SRL or its licensors and is protected by copyright.

You may watch purchased courses only for your personal learning. Downloading, recording, copying, publishing, sharing, reselling or any other use of the course materials without our written consent is prohibited and may lead to the suspension of your Account and to legal action.

10. Acceptable use

You agree to use the Site lawfully and not to interfere with its functioning, attempt to access other users’ accounts, or bypass any access restrictions.

We may suspend or close an Account that breaches these terms, in particular in case of sharing access or copying course materials.

11. Liability

We take reasonable care to keep the Site and the courses available and working. However, the Site may be temporarily unavailable due to maintenance, technical problems or events outside our control (for example failures of hosting, payment or internet providers, cyber attacks or force majeure).

To the extent permitted by law, our total liability towards a Client in connection with a course is limited to the price paid for that course. This limitation does not apply to damage caused intentionally or by gross negligence, and does not limit any rights you have under mandatory consumer protection law.

12. Complaints and dispute resolution

If you have a complaint, please write to office@jemshitmavlyanov.com. We will reply within 30 days.

If you are a consumer and we cannot resolve the issue together, you may contact the Romanian National Authority for Consumer Protection (ANPC, https://anpc.ro) or use alternative dispute resolution (SAL) through the ANPC platform: https://reclamatiisal.anpc.ro

13. Changes to these terms

We may update these terms from time to time. The version published on the Site at the time of your purchase applies to that purchase. Changes apply only to purchases made after they are published.

14. Governing law and language

These terms are governed by Romanian law. Disputes will be settled by the competent courts in Romania.

If you are a consumer living in another EU country, this does not deprive you of the protection of the mandatory laws of your country of residence, nor of your right to bring a claim before the courts of that country.

These terms are available in several languages. In case of any inconsistency between versions, the Romanian version prevails.
